Terms of Service

These Terms of Service ("Terms") are an agreement between you and Roamzy LLC, a Florida limited liability company ("Roamzy," "we," "us," or "our"). They govern your use of the Roamzy app for iPhone and our related websites and online services (collectively, the "Services").

By creating an account or using the Services, you agree to these Terms and acknowledge our Privacy Policy. If you do not agree, do not use the Services.

1. About Roamzy

Roamzy is a travel planning app. It helps you organize trips, places, bookings, notes, and packing lists, see maps and directions, and, if you choose, use AI features to import places and plan your days.

Roamzy is not a travel agency, tour operator, or booking service. We do not sell, book, or guarantee flights, hotels, tours, tickets, or any other travel services, and we do not act as your agent. Any booking you make is between you and the company you book with.

2. Eligibility

You must be at least 13 years old to use the Services. If you are under 18, you may use the Services only with the permission of a parent or legal guardian.

3. Your Account

You need a free account to use Roamzy. You can create one with your email address or by signing in with Apple or Google. Your trips are saved to your account, and a copy is kept on your device so they are available offline. You agree to give accurate information and keep it up to date.

You are responsible for keeping your password and devices secure and for all activity under your account. If you think someone has accessed your account without permission, email us right away at support@goroamzy.com.

4. Acceptable Use

You may use the Services only for lawful, personal, non-commercial travel planning. You agree not to:

  • break any law or violate anyone's rights;
  • add content that is illegal, harmful, harassing, or that you don't have the right to use;
  • access, or try to access, other users' accounts or data, or parts of the Services you are not permitted to access;
  • interfere with the Services, including by overloading them or getting around security or usage limits;
  • copy, modify, sell, or create works based on the Services, except as allowed by law;
  • reverse engineer the app, except where the law allows it despite this restriction;
  • use bots, scrapers, or other automated means to access the Services or collect data from them; or
  • use the Services or anything they produce to build a competing product or to train artificial intelligence models.

5. Your Content

The trips, notes, photos, screenshots, links, and other content you add to Roamzy ("Your Content") remain yours.

You give Roamzy a non-exclusive, worldwide, royalty-free license to store, copy, process, transmit, and display Your Content only as needed to provide the Services to you, including sending it to our service providers when you use a feature that needs them, as described in our Privacy Policy. This license ends when Your Content is deleted, except for copies kept for a limited time in backups or as required by law.

You confirm that you have the rights needed to add Your Content. When you import a video, link, or other material created by someone else, you are responsible for how you use it. We recommend keeping your own copies of important travel documents and confirmations.

6. AI Features and Travel Information

AI features. Some features use artificial intelligence from third parties to suggest itineraries, reorder or recommend places, find places in imported content, and read details from screenshots. AI features require an account and are currently limited to 10 uses per calendar month, which reset on the 1st of each month and do not carry over. We may change this limit. AI results are generated automatically and may be inaccurate, incomplete, out of date, or not right for you. They are not professional advice.

Travel information. Maps, directions, travel times, place details, opening hours, and photos come from third parties and may be wrong or out of date.

Check before you travel. You are responsible for your travel plans. Before relying on any information in Roamzy, including AI results, confirm the important details with the airline, hotel, venue, or official source. This includes bookings, prices, schedules, opening hours, entry and visa requirements, passport validity, health requirements, travel restrictions and advisories, safety information, and local laws. Roamzy is not responsible for missed flights, lost reservations, closures, extra costs, or other consequences of relying on information in the Services.

7. Third-Party Services and Links

Roamzy uses and links to services run by other companies, such as Apple, Google, Unsplash, Booking.com, and GetYourGuide. Your use of those services is governed by their own terms and privacy policies, and we are not responsible for them.

Any booking or purchase you make on another company's website is between you and that company. Contact them directly about changes, cancellations, and refunds.

Affiliate links. Some links in Roamzy are affiliate links, which means we may earn a commission if you book through them, at no extra cost to you. These links are marked as sponsored in the app.

8. Fees

Roamzy is currently free. If we offer paid features in the future, we will show you the price and terms before you buy, and purchases will be handled by Apple under the App Store's terms.

9. Roamzy's Rights

The Services, including the app, its design, text, graphics, logos, and the Roamzy name, belong to Roamzy or our licensors and are protected by law. As long as you follow these Terms, we give you a personal, limited, non-exclusive, non-transferable, revocable license to download and use the app on Apple devices you own or control, as permitted by the App Store's usage rules. We reserve all rights not expressly granted.

If you send us ideas or feedback, we may use them without any obligation to you.

If you believe something in the Services infringes your copyright, email support@goroamzy.com with a description of the work, where it appears in the Services, your contact information, and a statement that you believe in good faith that the use is not authorized.

10. Ending Your Use

You can stop using Roamzy at any time. You can delete your account in the app under Profile > Delete Account, or by emailing support@goroamzy.com.

We may suspend or end your access to the Services if we reasonably believe you have broken these Terms, if needed to protect the Services or other people, or if the law requires it. We may also change or discontinue the Services or any feature. When we can, we will give you notice of changes that significantly affect you.

Sections 5 through 7 and 9 through 16 continue to apply after your use ends.

11. Disclaimer of Warranties

THE SERVICES, INCLUDING AI RESULTS AND THIRD-PARTY INFORMATION, ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, ROAMZY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ACCURACY. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, THAT YOUR CONTENT WILL NOT BE LOST, OR THAT ANY INFORMATION WILL BE ACCURATE, COMPLETE, OR CURRENT. SOME STATES DO NOT ALLOW THESE EXCLUSIONS, SO THEY MAY NOT APPLY TO YOU.

12. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, ROAMZY AND ITS MEMBERS, MANAGERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, OR GOODWILL, OR ANY TRAVEL, ACCOMMODATION, OR REPLACEMENT COSTS, ARISING FROM OR RELATED TO THE SERVICES OR THESE TERMS, EVEN IF WE HAVE BEEN TOLD THEY ARE POSSIBLE.

TO THE FULLEST EXTENT PERMITTED BY LAW, ROAMZY'S TOTAL LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICES OR THESE TERMS WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE OR $50.

SOME STATES DO NOT ALLOW THESE LIMITATIONS, SO THEY MAY NOT APPLY TO YOU. NOTHING IN THESE TERMS LIMITS LIABILITY THAT CANNOT BE LIMITED BY LAW.

13. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Roamzy and its members, managers, employees, and agents from any claims, losses, and expenses, including reasonable attorneys' fees, arising from your breach of these Terms, Your Content, or your violation of any law or the rights of others.

14. Disputes

Contact us first. If you have a dispute with Roamzy, please email support@goroamzy.com and describe it. We will try in good faith to resolve it informally. Neither of us will start a lawsuit until 60 days after the dispute was first described in writing.

Courts. Any dispute that we cannot resolve informally will be resolved only in the state or federal courts located in Florida, and you and Roamzy consent to the jurisdiction of those courts. Either of us may instead bring an individual claim in small claims court if it qualifies.

15. Governing Law

These Terms are governed by the laws of the State of Florida, without regard to its conflict of law rules.

16. Apple

If you downloaded Roamzy from the App Store:

  • These Terms are between you and Roamzy, not Apple Inc. ("Apple"). Roamzy, not Apple, is responsible for the app and its content.
  • Your right to use the app is limited to Apple-branded devices you own or control, as permitted by the App Store's usage rules.
  • Apple has no obligation to provide maintenance or support for the app.
  • If the app fails to meet any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any. To the fullest extent permitted by law, Apple has no other warranty obligation for the app.
  • Roamzy, not Apple, is responsible for handling any claims relating to the app, including product liability claims, claims that the app fails to meet legal or regulatory requirements, and claims under consumer protection, privacy, or similar laws.
  • If anyone claims that the app infringes their intellectual property rights, Roamzy, not Apple, is responsible for investigating, defending, settling, and resolving the claim.
  • You confirm that you are not located in a country subject to a U.S. government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. government list of prohibited or restricted parties.
  • You must comply with any third-party terms that apply when you use the app.
  • Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

17. General

Changes to these Terms. We may update these Terms from time to time. When we do, we will change the date at the top. If we make important changes, we will let you know in the app before they take effect. If you keep using the Services after the changes take effect, you accept the updated Terms.

Entire agreement. These Terms and our Privacy Policy are the entire agreement between you and Roamzy about the Services.

Severability. If any part of these Terms is found unenforceable, the rest remains in effect.

No waiver. If we do not enforce part of these Terms, that does not mean we give up the right to enforce it later.

Assignment. You may not transfer these Terms without our written permission. We may transfer them as part of a merger, acquisition, or sale of assets.
